ELADÂR — Private estate near Marrakech

Article 1 — Purpose
These Terms and Conditions of Sale (hereinafter “Terms & conditions”) define the booking, payment, cancellation and stay arrangements at the private estate Eladâr, located in the Marrakech region of Morocco.
They govern the contractual relationship between Atlantic Nomad Ventures SARLAU, hereinafter referred to as “Eladâr”, and any natural or legal person making a booking, hereinafter referred to as “the Client”.
Any confirmed booking implies that the Client has read and accepted these Terms & Conditions, which are communicated to the Client before the contract is concluded.
Article 2 — Presentation of the estate
Eladâr is a private estate offered exclusively for rental in its entirety.
The property includes five suites, indoor and outdoor living spaces, landscaped gardens, a 20-metre outdoor infinity pool, an indoor pool and a traditional hammam.
The booking guarantees the Client private use of the spaces made available for their stay, in accordance with the conditions specified in the booking confirmation.
Eladâr does not offer individual room rentals.
Article 3 — Minimum stay and capacity
The minimum booking duration is set at two consecutive nights.
The number of persons permitted to stay at the estate may not exceed the maximum capacity communicated at the time of booking, namely 10 people, children included.
Any change in the number of occupants must be notified in advance and accepted in writing by Eladâr.
Receiving visitors who are not part of the originally declared group is subject to prior authorisation.
Article 4 — Booking and confirmation
Booking requests may be made via the website www.domaine-eladar.com, by email or by any other means of contact offered by Eladâr.
All requests are subject to the estate’s availability.
A proposal specifying the dates of the stay, the number of occupants, the rate, the services included and any supplements is sent to the Client.
The booking becomes firm and final upon written acceptance of this proposal, acceptance of these Terms & conditions and receipt of a deposit corresponding to 30% of the total cost of the stay.
Written confirmation is then sent to the Client.
Article 5 — Rates and payment terms
The applicable rates are those stated in the booking proposal accepted by the Client.
They are expressed in Euros under the Moroccan tax regime.
Payment terms are as follows:
- 30% deposit when the booking is confirmed.
- 70% balance to be paid no later than 30 days before the arrival date.
- For any booking made less than 30 days before arrival, 100% of the cost of the stay is payable upon confirmation.
Accepted payment methods and any bank charges are specified in the booking proposal.
Additional services requested before or during the stay are invoiced at the rates communicated to and accepted by the Client.
In the absence of payment by the agreed deadlines, Eladâr may, after written notice and in compliance with applicable legal provisions, cancel the booking under the conditions set out in these Terms & conditions.
Article 6 — Cancellation and modification terms
Any request for cancellation or modification must be sent to Eladâr in writing.
The following cancellation conditions apply, subject to mandatory legal provisions.
Cancellation more than 60 days before arrival
The Client receives a full refund of the sums paid for their stay.
Cancellation between 60 and 31 days before arrival
The 30 % deposit is retained by Eladâr. Any sums paid beyond this deposit are refunded.
Cancellation 30 days or less before arrival
The full amount of the stay remains due. No refund is provided, except where mandatory legal provisions require otherwise or by exceptional written agreement from Eladâr.
No-show and early departure
In the event of a no-show or early departure at the Client’s initiative, the total amount of the booked stay remains due, subject to applicable legal provisions.
Changes or postponement of the stay
Any request to change dates is considered individually, subject to the estate’s availability.
A postponement may be offered on an exceptional basis, without constituting an automatic right for the Client. It may entail a price adjustment depending on the new dates chosen.
Should Eladâr be unable to honour a confirmed booking, the Client will be informed as soon as possible. The terms of refund or alternative solution are determined in accordance with the contract and applicable law.
Article 7 — Security deposit
A security deposit of 1 000 € is requested before arrival, according to the terms communicated at the time of booking.
It is intended to cover any deterioration, loss, material damage or sums remaining due at the end of the stay.
The security deposit is returned after departure, within 5 days, subject to an inspection of the condition of the estate and its facilities.
Any amount withheld must be justified by appropriate evidence and correspond to the costs actually attributable to the Client.
The security deposit does not constitute an advance payment for services.
Article 8 — Arrival and departure
Check-in and check-out times are as follows:
Check-in: from 3 pm.
Check-out: before 12 noon.
Any request for early arrival or late departure must be made in advance and remains subject to the estate’s availability.
Additional charges may apply, provided they have been communicated in advance and accepted by the Client.
Article 9 — Services included in the stay
The stay includes private use of the estate, its five suites and the spaces and facilities set out in the booking proposal.
Breakfast is included in the price of the stay.
A dedicated team looks after welcoming guests, maintaining the estate and ensuring the stay runs smoothly, within the scope of the agreed services.
Services not expressly stated as included may be subject to additional charges.
Article 10 — Dining and additional services
Eladâr offers a dining service on request, with home cooking inspired by Moroccan traditions and seasonal produce.
Indicative rates are as follows:
- Lunch: 25 € per person.
- Dinner: from 35 € per person.
Elaborate menus, specific requests and special gastronomic services may be subject to adjusted pricing, communicated before they are confirmed.
Additional services can also be organised, including private transfers, excursions, massages, yoga sessions, childcare and other bespoke services.
These services are offered subject to availability and may be provided by external practitioners.
Pricing information is provided in advance for any additional service.
Article 11 — Pools and hammam
Eladâr has two pools:
- A 20-metre outdoor infinity pool, open to the landscapes of the Atlas.
- An indoor pool located in the pool house.
Both pools can be heated on request, for an additional charge.
Heating rates are as follows:
- Pre-heating fee: 200 €, charged once only for the initial heating of both pools.
- Heating fee: 100 € per day, to keep both pools at temperature.
These rates apply to both pools together and are not charged separately for each one.
The Client must submit their heating request before arrival, with sufficient notice to allow the facilities to be prepared.
The corresponding fees are confirmed when this additional service is booked.
The traditional wood-fired hammam requires advance preparation arranged with the estate team.
The pools, hammam and wellness facilities must be used in accordance with the safety instructions provided on site.
Article 12 — Children and pets
Children are welcome at Eladâr.
They remain under the supervision and responsibility of the adults accompanying them for the entire duration of the stay.
Particular care is required near the pools, the outdoor areas and the animals present on the estate.
A childcare service can be arranged on request, subject to availability.
Pets are not permitted on the property.
Article 13 — Care of the estate and its facilities
The Client undertakes to use the estate, its facilities, furniture and equipment with care and in accordance with their intended purpose.
The Client is required to respect the safety instructions, the tranquillity of the premises and the reasonable instructions given by the team.
Any damage, loss or deterioration attributable to the Client or to the persons for whom they are responsible may give rise to a claim for repair or reimbursement, upon presentation of the appropriate supporting documents.
Equipment, furniture and decorative items may not be moved off the property.
Any use of the estate likely to present a risk to people, facilities or the environment is prohibited.
Article 14 — Visitors and private events
The booking of the estate is intended exclusively for the persons declared at the time the stay is confirmed.
Receiving outside visitors and organising parties, receptions or special gatherings require Eladâr’s prior written authorisation.
Private events, celebrations, retreats and other gatherings may be subject to special conditions, in particular regarding capacity, timings, external providers and additional fees.
These conditions are set out in a separate proposal or contract.
Article 15 — Photo shoots, filming and commercial use
Any use of the estate for professional, commercial, advertising, photographic or audiovisual purposes requires prior written authorisation.
Photo shoots, filming, commercial content production and promotional operations are subject to specific booking and pricing conditions.
A standard accommodation booking does not automatically authorise the organisation of such activities.
Article 16 — Liability and safety
Eladâr ensures that the property and its facilities are maintained in appropriate conditions of comfort and safety.
The Client undertakes to follow the instructions provided and to exercise caution when using the facilities.
Children must be supervised by the adults accompanying them, particularly around the pools and in the outdoor areas.
Personal belongings and valuables remain in the care of their owners, without prejudice to any legal liability that may fall to Eladâr.
Services provided by external practitioners are subject to the liabilities and contractual conditions applicable to each service.
Nothing in these terms and conditions shall exclude or limit any liability where the law prohibits it.
Article 17 — Force majeure
In the event of force majeure, as defined by applicable law, preventing the total or partial performance of contractual obligations, the party concerned shall inform the other as soon as possible.
The consequences for the booking, including any possibility of postponement, cancellation or refund, are determined in accordance with the applicable legal and contractual provisions.
Article 18 — Personal data
Personal data collected during a booking request or a stay is used to process requests, manage bookings, issue invoices and carry out the necessary communications with the Client.
They are processed in accordance with the applicable personal data protection legislation, in particular Moroccan Law No. 09-08 where applicable.

Article 19 — Complaints and dispute resolution
Any complaint relating to a booking or a stay must be sent in writing to:

Eladâr undertakes to examine any complaints received and to seek, wherever possible, an amicable solution.
Failing agreement, the dispute shall be submitted to the rules of jurisdiction provided for by the applicable law, without prejudice to the mandatory provisions protecting the Client.
Article 20 — Applicable law
These Terms and Conditions of Sale are governed by Moroccan law, subject to any mandatory provisions that may apply to the Client by reason of their situation or the booking arrangements.
Article 21 — Acceptance of the terms and conditions
The Client acknowledges having received, before confirming their booking, the essential information concerning the estate, the price of the stay, the services included, the payment terms, the cancellation conditions and any additional fees.
Confirmation of the booking constitutes acceptance of these Terms & conditions, under the conditions provided by applicable regulations.
